Terms and Conditions

1. Introduction

These Terms and Conditions ("Terms") govern your use of the website, Kickstarter campaign, newsletter, and the AR Battle Core mobile application (collectively, the "Services") provided by Aileon Consulting SARL ("we", "us", "our"), a company registered in France.

By accessing our website, backing our Kickstarter campaign, subscribing to our newsletter, or creating an App account, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

3. The Product

AR Battle Core is a radio-controlled (RC) tank toy with an integrated augmented reality (AR) application, distributed globally. The product is initially offered via a Kickstarter crowdfunding campaign.

 

4. Kickstarter Campaign

4.1 Nature of Crowdfunding

Our Kickstarter campaign is a rewards-based crowdfunding campaign. Backing the campaign is not an investment and does not grant you equity, shares, or any financial return. Backers support the project in exchange for defined rewards (the product and/or related perks).

 

4.2 Campaign Risks

Crowdfunding involves inherent risks, including production delays, changes to product specifications, or, in extreme cases, inability to deliver. While we are committed to fulfilling all pledges, we cannot guarantee delivery by any specific date. We will communicate transparently with backers about the project's progress.

 

4.3 Kickstarter Platform Terms

The campaign is also governed by Kickstarter's Terms of Use. In the event of a conflict, Kickstarter's terms regarding the platform itself take precedence.

 

4.4 Refunds

Once a Kickstarter campaign ends, pledges are generally non-refundable under Kickstarter's policies. However, we reserve the right to issue refunds at our discretion in exceptional circumstances (e.g., if the product cannot be delivered). Direct sales outside Kickstarter are subject to applicable consumer law return rights.

 

5. Newsletter

You may subscribe to our newsletter to receive product news and updates. Subscription requires your email address and is based on double opt-in confirmation. You may unsubscribe at any time by clicking the unsubscribe link in any newsletter email or by contacting us. We will not use your email for purposes other than the newsletter without your further consent.

 

6. App Account and User Profile

6.1 Account Creation

To use certain features of the AR Battle Core App, you must create a user account. You must provide accurate information and keep your credentials confidential. You are responsible for all activity under your account.

 

6.2 Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or are inactive for an extended period (more than [24] months). You may delete your account at any time by contacting us at info@realityforge.ai .

 

6.3 No Advertising in the App

The App does not contain third-party advertising. Your App usage data is not shared with advertisers.

 

7. Intellectual Property

All content, software, trademarks, designs, and materials related to AR Battle Core and the App are the exclusive property of Aileon Consulting EURL or its licensors. You may not copy, modify, distribute, sell, or exploit any part of our intellectual property without prior written consent.

The App is licensed to you on a limited, non-exclusive, non-transferable, revocable basis for personal, non-commercial use only.

 

8. User Conduct

You agree not to:

  • Use the App or Services for any unlawful purpose

  • Attempt to reverse-engineer, hack, or tamper with the App or connected hardware

  • Use the Services to harass, harm, or infringe the rights of others

  • Upload or transmit malicious code or content

  • Impersonate any person or entity

 

9. Limitation of Liability

To the maximum extent permitted by applicable law:

  • We are not liable for indirect, incidental, special, or consequential damages arising from the use or inability to use our Services.

  • Our total liability for any claim arising from these Terms shall not exceed the amount paid by you for the relevant product or service.

  • We are not liable for delays or failures caused by circumstances beyond our reasonable control (force majeure), including supply chain disruptions, pandemics, or natural disasters.

 

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.

 

10. Consumer Rights

If you are a consumer resident in the European Union or UK, you benefit from mandatory statutory consumer protection rights that cannot be excluded by these Terms. This includes the right to a legal guarantee of conformity for physical goods (2 years in the EU) and applicable withdrawal rights for distance selling. Nothing in these Terms affects your statutory rights.

 

11. Applicable Law and Jurisdiction

These Terms are governed by the laws of France, without regard to its conflict of law provisions. For disputes with EU consumers, the mandatory consumer protection laws of your country of residence may also apply.

Any disputes shall first be subject to good-faith negotiation. If unresolved, disputes may be submitted to the competent courts of [Angouleme, France] or to the Online Dispute Resolution platform of the European Commission: https://ec.europa.eu/consumers/odr

 

12. Modifications to Terms

We reserve the right to update these Terms at any time. We will provide reasonable notice (e.g., by email or in-App notification) before changes take effect. Continued use of the Services after the effective date constitutes acceptance of the updated Terms.

 

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
